1. Description of Service

Feetsu.jp provides an AI-powered image processing service that utilizes artificial intelligence and machine learning technologies to transform and modify images uploaded by users. The Service is provided on an "as is" and "as available" basis.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. AI Technology Disclaimer and No Warranty

IMPORTANT: THE SERVICE UTILIZES ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING TECHNOLOGIES. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• AI May Make Mistakes: Artificial intelligence systems are inherently imperfect and may produce inaccurate, incomplete, misleading, offensive, or otherwise objectionable outputs. AI-generated results may contain errors, hallucinations, artifacts, distortions, or unintended modifications.
• No Guarantee of Accuracy: We do not guarantee the accuracy, reliability, completeness, quality, or suitability of any AI-generated content. The results may not meet your expectations or requirements.
• Results May Vary: AI outputs can be unpredictable and may vary significantly between uses, even with identical inputs. Consistent or reproducible results are not guaranteed.
• No Fitness for Purpose: We make no warranty that the Service or AI-generated outputs will be fit for any particular purpose, whether commercial, personal, professional, or otherwise.
• Technological Limitations: Current AI technology has inherent limitations and may not perform as expected in all circumstances. We are not responsible for any limitations in AI capabilities.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF THE SERVICE OR ANY CONTENT;
• WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• No Consequential Damages: IN NO EVENT SHALL FEETSU.JP, ITS OWNERS, OPERATORS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
• Maximum Liability Cap: OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).
• Basis of the Bargain: THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US. THE SERVICE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.
• Applicable Regardless of Theory: THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload, process, or transmit any content that you do not have the right to use, including images that infringe on intellectual property rights or privacy rights of others;
• Upload images containing minors or any illegal content;
• Use the Service to create content that is illegal, harmful, threatening, abusive or otherwise objectionable;
• Attempt to probe, scan, or test the vulnerability of the Service or any related system or network;
• Use the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service;
• Use any automated means, including robots, crawlers, or data mining tools, to access or use the Service;
• Violate any applicable local, state, national, or international law or regulation.

8. Intellectual Property Rights

You retain all rights to the original images you upload to the Service. You grant us a limited, non-exclusive, royalty-free license to process your images solely for the purpose of providing the Service to you. You represent and warrant that you have all necessary rights to upload and process any images you submit.

The Service, including its design, features, functionality, and underlying technology, is owned by feetsu.jp and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

9. Subscription and Payment Terms

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis (monthly or as otherwise specified). You authorize us to charge your designated payment method for all fees incurred.

All payments are non-refundable except as expressly set forth herein or as required by applicable law. We reserve the right to change our subscription fees at any time upon reasonable notice.

10. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods, except as required by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless feetsu.jp and its owners, operators, affiliates, directors, officers, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party, including any intellectual property or privacy rights; (d) any content you upload, submit, or transmit through the Service; or (e) your negligent or wrongful conduct.

12. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice, and without liability to you. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Tokyo, Japan, and you consent to the personal jurisdiction of such courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and feetsu.jp regarding your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us.

18. Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
